WHAT IS YOUR POLICY FOR SAMPLES?
Our memo samples are available in various sizes depending upon pattern repeat. Memos are free of charge and on a 30-day loan. We reserve the right to invoice for memos if they are not returned in a reasonable amount of time.
CAN I PLACE A FABRIC ON RESERVE?
Yes. We reserve fabrics for 14 days. However, we reserve the right to cancel any reserve at any time.
HOW DO I ORDER FABRICS OR SAMPLES?
To order memos or fabrics, please go to the Fabrics or Trims page and add the memo or fabric to your cart! Alternatively, you can email your request to firstname.lastname@example.org. HOW MUCH LEAD TIME IS REQUIRED FOR DELIVERY?
We stock the majority of our fabrics in Hicksville, NY. Some Victor Thomas products are stocked overseas and require 1-2 weeks for delivery. Transit times varies based upon your location. For backordered fabrics, lead times vary; please contact us for more details.
WHAT IS YOUR MINIMUM ORDER REQUIREMENT?
We have a 3 yard minimum order requirement for our fabrics; we waive this minimum to 1 yard with a cut fee if the fabric is in stock. Please note that we sell our fabric in 0.50 yard increments.
HOW WILL MY MERCHANDISE BE SHIPPED?
We ship our fabrics insured via FedEx. We can also ship using your account with a handling fee.
HOW DO YOU PRICE YOUR FABRICS?
Our price list is Designer Net/ Wholesale/ To the Trade. Freight charges apply. Prices are subject to change without notification.
WHAT IS YOUR PAYMENT TERMS?
On in-stock fabrics, full payment is due before shipping. On backordered fabrics, we require a 50% deposit and the balance is due prior to shipping.
WHAT FORM OF PAYMENT IS ACCEPTABLE?
All checks should be made payable to Texture, Inc. We also accept all major credit cards.
GENERAL TERMS AND CONDITIONS OF SALE
Texture, Inc. (“Texture”) general terms and conditions of sale, including and not limited to, are listed below:
All prices are net, FOB Hicksville, NY; freight and special processes are additional. Texture reserves the right to change prices without prior notice. Prices should be checked with our corporate office or the nearest showroom prior to ordering.
Full payment, including freight and any other miscellaneous itemized charges, is required prior to shipment unless credit has been established. If terms are established, payment is due on or prior to the due date listed on the invoice via check No credit card payments are accepted if credit terms are extended to the customer. Payments not received on or before their due date are subject to a late fee of 6% of the invoice amount (including without limitation any previously assessed but unpaid late payment fees). Once the customer has reached their credit limit, Texture may hold the future shipments and place customer on proforma until the account is in good standing. In case of collection, any and all collection costs will be for the account of the customer. Returned/ bounced check fee is $30 per check.
A written purchase order is requested via email (email@example.com). Telephone orders are accepted; however, Texture will accept no responsibility for merchandise or quantity discrepancies on telephone orders. Fabric name and color and ALL shipping instructions must be included in the order. If necessary, please specify cut lengths required for fabrics. Please specify face or back for reversible fabrics.
Fabric is sold in multiples of 1/2 yards with a 3 yard minimum per fabric. At Texture’s discretion, and for in-stock fabrics, the minimum per fabric maybe waived to 1 yard and a $20 cut fee will apply to each fabric ordered in quantities less than the minimum.
Orders are subject to acceptance with issuance of written order acknowledgments which are final and binding. Our order acknowledgments will include an anticipated delivery date. Orders may only be changed prior to shipment by written request. All such requests are subject to Texture's ability to conform. Additional material, labor, administrative and/or other costs may be charged.
Complete shipping instructions as to carrier and routing should be included with the order. If no routing is specified (or if "best" routing is requested) Texture will select an appropriate carrier and will quote/invoice such shipping charges to the customer.
As inventory levels can fluctuate due to allowances or shortages, Texture will work with the customer to adjust cut lengths as necessary. Such circumstances may delay the release of goods for shipping. We reserve the right to make partial shipments as fabric is available.
Orders cannot be canceled without the written consent of Texture. For in-stock fabrics, a cancellation charge of 25% of the total designer net price will apply. Orders requiring a deposit for which deposit has been received are non-cancelable without forfeiture of entire deposit.
No claim may be made after a fabric has been cut or processed. Claims must be made in writing within 4 weeks from date of receipt of fabric. Texture will not be responsible for any costs other than those billed by Texture.
In case of drop shipments, it is the customer’s responsibility to assure the recipient has a sample to match with the shipped goods. No claims will be honored if the goods are fabricated or cut. Product must be inspected for flaws, patterns, color, quality and piece sizes before fabricating/processing it.
No fabrics may be returned without Texture's prior written consent. There is a maximum of 30 days you have to contact Texture if you need to return anything. Unauthorized returns will not be accepted. For non-faulty merchandise, a restocking/ handling charge of 25% of the designer net price will be charged on all approved returns which must have a Texture Return Goods Authorization form attached. Credit will be issued as merchandise credit.
There are no returns on discontinued or discounted products. Further there are no returns on products that have been altered or fabricated. Velvet fabrics and trims are not returnable. Fabric/Trim piece sizes less than 10 yards are not returnable.
Freight charges for returns are not reimbursable.
Variations in dyes, dye lots, yarns and spinning lots may cause variations between samples and inventoried/ shipped fabric. A cutting of current stock can be requested along with the purchase order. All weights and dimensions are approximate. Fabric is not guaranteed against fading, wearing, dimensional change or any other physical changes in appearance. Fabric width and repeats may vary up to 5%. Shrinkage is also normal even for preshrunk fabric up to 3%.
SILK AND NATURAL FIBERS
Natural products such as silk, linen and cotton will have natural imperfections. Slubs, dyelot variation, bubs and nominal pattern variation is to be expected and is a part of the natural beauty and should not be considered defects.
Velvet products are delicate, and unless purchased with the suspended box, should be stored correctly. Please store them in a horizontal, hanging position to avoid any kind of crease marks. Texture can not be held responsible for velvets that are stored for long time or stored improperly.
NOVELTY PRODUCTS – HAND EMBROIDERED AND STUDDED
Since many of the embroidered and studded products are hand made, some variation in repeat and design is deemed acceptable. Also note that these items may be delicate and should be handled with care.
SPECIAL PROCESS AND SERVICES
The addition of topical and back coating treatments to any fabric can change the color, hand or performance. Texture will not accept responsibility for any fabric that has been processed by an outside finisher.
Please order an additional 1 yard, per cut, to ensure enough return after working loss.
Texture offers third party finishing services at an additional charge and may bill the client for shipping to the finisher and to the final destination. These orders are not returnable. Texture will not be responsible for any variations as a result of the specified elective finish.
Memo samples are available on loan and must be returned within 30 days or a charge of $15 per sample will apply. All sample books are on loan and the property of Texture and Texture may request that these be returned at its sole discretion.
Reserves are good for two weeks and may be placed on fabric in stock; reserves against incoming stock will be accepted at Texture’s discretion. Reserves expire automatically after two weeks; no reminders are sent.
CFA (cutting for approval) can be requested for fabrics. These will be held for 2 weeks after we send it from our warehouse. There is a 3 yard minimum if you request a CFA or a cut fee will apply.
If testing information is required which is not contained herein, please contact our corporate office. Additional charges may apply for such testing.
Texture will develop custom colors and/or designs. Custom orders will be accepted at Texture's discretion if sufficient time and minimum yardage requirements are met.
All custom orders require a written purchase order, a set-up fee (if applicable) and a non-refundable 50% deposit to begin production. All custom orders are subject to a maximum of 10% overage on the production run; adjustments will be made on the final invoice.
Custom orders may not be canceled or returned unless the product is defective. Texture's ability to produce a custom design or color once does not guarantee Texture's ability to produce it in the future, which should be considered when calculating attic stock. Texture will not be liable for any delays or failure to deliver product if these delays are cause by labor disputes, limitations of the machines or country it is imported from, shortage of raw material, act of nature or any other act beyond our control.
By law, Texture is required to collect sales tax in NY. Sales tax charges are based on the state the orders are shipped to. Customers who provide us with a valid resale tax certificate are not charged sales tax when goods are shipped into that state.
